Preamble

The seller markets Products and Services via the Site. The list and description of the Products and Services offered by the Seller can be viewed on the product pages.

 

Article 1 - Subject

These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products or Services offered by the Seller.

 

Article 2 - Price

Our product prices are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

For orders to countries other than mainland France, the Buyer is the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the Company. They shall be borne by the Buyer and are their sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in their country. We advise you to enquire about these aspects with your local authorities.

All orders, regardless of their origin, are payable in euros.

The Company reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of order validation and subject to availability.

The products remain the property of the Company until full payment of the price.

Once the Customer is in physical possession of the ordered products, the risks of loss or damage to the products are transferred to them.

 

Article 3 - Orders

The buyer can place an order on the Site. The contractual information is presented in French and will be subject to confirmation at the latest at the time of validation of your order.

The Company reserves the right not to register a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

 

Article 4 - Validation of your order

Any order appearing on the Site implies adherence to these General Terms and Conditions. Any order confirmation entails full and complete acceptance by the Buyer of these general terms and conditions of sale, without exception or reservation.

All data provided and the recorded confirmation will serve as proof of the transaction.

The buyer declares that they have full knowledge of them.

The order confirmation will serve as signature and acceptance of the operations carried out.

A summary of your order information as well as a link to these General Terms and Conditions will be sent to you via your order confirmation email.

 

Article 5 - Payment

Validating your order implies the Buyer's obligation to pay the indicated price.

Payment for your purchases is made by bank card using the secure Stripe system.

The card is debited only at the time of shipment of the order.

 

Article 6 - Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, the Buyer has a withdrawal period of 14 days from receipt of their products to exercise their right of withdrawal without having to justify reasons or pay a penalty.

Returns must be made in their original and complete condition (packaging, accessories, instructions). In this context, the buyer is held responsible. Any damage suffered by the product on this occasion may be such as to invalidate the right of withdrawal.

Return costs are borne by the Company if the returns come from the following countries: Germany, Austria, Belgium, Croatia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Slovakia, Slovenia. Otherwise, return costs are the responsibility of the Buyer.

In the event of exercising the right of withdrawal, the Company will reimburse the sums paid within 14 days following notification of your request and via the same payment method as that used during the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• The supply of goods made to the consumer's specifications or clearly personalized.

• The supply of goods liable to deteriorate or expire rapidly.

 

Article 7 - Availability

Our products are offered as long as they are visible on the Site and within the limits of available stocks. For products not held in stock, our offers are valid subject to availability from our suppliers.

In case of product unavailability after placing your order, the Company will inform the Buyer by email. The order will be automatically cancelled and no bank debit will be made.

 

Article 8 - Delivery

The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the "Deliveries and returns" page.

In case of delay in shipment, an email will be sent to the Buyer to inform them of a possible consequence on the indicated delivery time.

In accordance with legal provisions, in case of late delivery, the Buyer has the possibility to cancel the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. If the Buyer receives the product in the meantime, the Seller will proceed to its reimbursement and the delivery costs under the conditions of Article L 138-3 of the Consumer Code.

In case of delivery by a carrier, the Company cannot be held responsible for late delivery due exclusively to the Client's unavailability after several appointment proposals.

 

Article 9 - Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by Articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.

All claims, requests for exchange or refund must be made by email within 30 days of delivery.

Products must be returned to the Company in the condition in which the Customer received them with all elements (accessories, packaging, instructions...). Shipping costs will be reimbursed to the Customer based on the invoiced rate and return costs will be reimbursed upon presentation of supporting documents.

The provisions of this Article do not prevent the Buyer from benefiting from the right of withdrawal provided for in Article 6.

Article 10 - Liability

The products offered comply with current French legislation. The Company's liability cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered. It is up to the Customer to check with local authorities regarding the possibilities of importing or using the products or services they intend to order.

Furthermore, the Company cannot be held liable for damages resulting from improper use of the purchased product.

Finally, the Company's liability cannot be engaged for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

 

Article 11 - Applicable law in case of disputes

The language of this contract is French. These terms of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.

 

Article 12 - Personal data

The Company reserves the right to collect personal information and personal data concerning the Customer. It is necessary for order management, as well as for the improvement of the services and information that the Seller makes available to the Buyer.

It may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

Article 13 - Archiving

The Company will archive order forms and invoices on a reliable and durable medium constituting a true copy.
